Terms of Use

These terms govern your use of the jayhawkdiggers.com.au website (the "site") and general dealings with Jay-Hawk Diggers (ABN 67 821 841 057). By using the site or buying from us, you agree to these terms.
1. About us
Jay-Hawk Diggers is an Australian dealer importing and selling compact mini excavators (the "machines") and attachments. Contact us at jeremy@jayhawkdiggers.com.au or 0422 999 583.
2. Use of the site
You may use this site for personal, non-commercial information about our products. You agree not to:
- Interfere with the site's security, availability or normal operation;
- Copy or republish substantial parts of the site without our permission;
- Use the site for anything unlawful, misleading or infringing.
3. Product information and pricing
We try to keep specifications, photos and prices on the site accurate, but the site is for general information. Specifications can change without notice and photos may show options or attachments that are not included. Prices are in Australian dollars and include GST unless stated otherwise. Freight is quoted separately based on your delivery address. The price and inclusions confirmed in writing in your invoice prevail over anything on the site.
4. Enquiries, quotes and orders
Submitting an enquiry does not create a contract. An order is only accepted when we issue you a written invoice or order confirmation and we have received your deposit or payment as agreed. We may decline or cancel an order before delivery (for example, if stock is unavailable or there is an obvious pricing error), in which case we will refund any money already paid.
5. Freight and delivery
We arrange door-to-door freight Australia-wide through third-party carriers. Delivery timeframes are estimates only and are not guaranteed. Risk in the machine passes to you on delivery. Please inspect on arrival and note any damage on the delivery paperwork.
6. Warranty and Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In addition, we offer the Jay-Hawk machine warranty. Warranty terms, coverage and exclusions are set out in the warranty document supplied with your machine. The Jay-Hawk warranty does not limit or replace your rights under the Australian Consumer Law.
7. Limitation of liability
To the extent permitted by law, and other than as required by the Australian Consumer Law, our liability for any claim arising out of the site or the supply of a machine is limited, at our option, to repair or replacement of the machine or supply of an equivalent, or refund of the price paid. We are not liable for indirect or consequential loss (such as loss of profit, downtime or contract loss).
8. Intellectual property
The Jay-Hawk Diggers name, logo, content, photos and site design are owned by us or used with permission. You must not use them without our prior written consent, except for normal browsing of the site.
9. Third-party links
The site may link to third-party sites. We do not control or endorse those sites and are not responsible for their content or practices.
10. Privacy
Our handling of your personal information is set out in our Privacy Policy.
11. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
12. Changes
We may update these terms from time to time. The "Effective" date above shows when they were last changed. Continued use of the site after a change means you accept the updated terms.
